The federal laws that protect your rights as an employee

Older employees are not less capable or smart than their younger counterparts, but they sometimes experience age-related mistreatment at their place of work. If you are an older Texas employee, you may find that you experience negative or inappropriate treatment because of your age. You may think this is simply the way it is, and you will just have to put up with it if you want to continue to work. 

In reality, you do not have to put up with this type of treatment. It is possible you are experiencing age discrimination, which is illegal. In fact, there are federal laws that protect your rights and allow you the right to seek legal recourse if you experience discrimination. The Age Discrimination in Employment Act keeps employers from discriminating against employees and applicants because of their age.

What does the ADEA mean for you?

Many people who experience age discrimination in the workplace are afraid to speak up. They may fear for their jobs, or they may fear that no one will believe their allegations. Some of the specific things that the ADEA outlines regarding age discrimination include the following: 

  • Employers cannot discriminate against a person because of his or her age at any point in the employment process. This includes hiring, training, promoting and making other decisions that impact employees.
  • Employers should not list an age preference for a job unless it is a genuine requirement for the job and necessary for the specific work the employee will have to do.
  • Employers cannot force their older workers to retire early, nor can they reduce or take away their health care insurance. They also cannot take away their benefits. 

If you experience age discrimination and you choose to report it, it is your right to do so. Your employer cannot discriminate against you further or take retaliatory action against you for speaking up against mistreatment.
